Given the large amount of discussion taking place on forums and
elsewhere, we understand why you have asked us for clarification
regarding the US Treasury's decision to adopt a final rule to implement
applicable provisions of the Unlawful Internet Gambling Enforcement Act
of 2006.
Cutting through the volume of discussion that is taking place, the main
point to make is that from the perspective of our customers nothing has
changed. The legal reasons we have identified, that we argue allows us
to continue operating in the US, remain as relevant now as they did
before these final rules were passed. See:

In fact, it may surprise you to hear that in our view things have
improved for two reasons.
First, the good news from a player's perspective is that the final rules
make it expressly clear that the term "restricted transaction" would not
include funds going to a consumer. Put simply, we hope this means we
can make it even easier for you to get your money out of your account.
We will be working on this clarification to your advantage.
Second, in order for the transaction to be caught by these rules, the
"bet" or "wager" must be connected to a game where there is
"significant" chance. The use of the phrase "significant chance" in the
context of gaming is new to us. At the very least this means that we
can argue that poker is not a game that involves "significant chance".
We are working with our legal team to research all relevant case law to
help us make the argument that this drafting excludes poker.
So you will see from the above that we are not at all discouraged by
these final rules. There is still lots of legal work to be done and you
can rest assured we have made this our top priority. In the meantime, we
